Alhamdulillah, Islam provides guidance and protection for those who are abused or oppressed. Our process at the Islamic Sharia Council of California ensures justice, fairness, and adherence to the principles of Shari’ah. Please find below a summary of our marriage dissolution procedure:
1. Submission of Application
You may begin by submitting your application online through our official portal. Once received, our team will review it and schedule an in-person appointment.
2. In-Person Hearing
During the appointment, you will be seen by a panel of qualified Islamic scholars. You will be given the opportunity to present your case and explain what outcome you are seeking from the council. After a thorough question-and-answer session, your case will be assigned to a designated member of the council.
3. Contacting the Spouse
The assigned council member will reach out to your spouse and issue a formal notice, allowing 45 days for a response.
- If the spouse responds, we will inform you and proceed with any necessary next steps.
- If there is no response, a second notice will be issued with an additional 30-day period.
- If there is still no response, a final notice will be sent with 15 days to respond.
4. Final Deliberation
If there is no response after the third and final notice, your case will be brought back to the full council at the next meeting.
- If the council determines that there are valid Islamic grounds for annulment or divorce, your marriage will be formally annulled, and you will be issued a letter confirming the decision.
- If the council concludes that there are no Shari’/religious grounds for dissolution, your case will be respectfully dismissed. In such instances, you may be advised to seek counseling or other forms of resolution, as the council must operate within the limits of Islamic jurisprudence.
